Terms of Service

1. Acceptance of Terms
By accessing and using the DevLoot marketplace ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not use this Platform.
DevLoot ("Company," "we," "us," or "our") reserves the right to modify these terms at any time. Your continued use of the Platform following the posting of changes constitutes your acceptance of the modified terms.
2. Definitions
- Account: Your user account on the DevLoot platform
- Content: All information, data, text, images, products, and materials on the Platform
- Creator/Vendor: A user who uploads and sells products on DevLoot
- Customer/Buyer: A user who purchases products from the Platform
- Platform: The DevLoot marketplace website and all associated services
- Product: Digital assets, tools, and resources offered for sale
3. Account Eligibility and Registration
To create an account on DevLoot, you must:
- Be at least 18 years of age or have parental/guardian consent
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Not impersonate any person or entity
- Not create multiple accounts to circumvent policies or restrictions
- Comply with all applicable laws and regulations in your jurisdiction
You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. Account Holder Responsibilities
As an account holder, you agree to:
- Maintain accurate and up-to-date account information
- Protect your password and account credentials
- Accept full responsibility for all activities under your account
- Comply with all applicable laws and these Terms of Service
- Resolve disputes with other users in good faith
- Report any suspicious activity or security concerns immediately
DevLoot is not responsible for unauthorized access to your account resulting from your failure to protect your credentials.
5. Acceptable Use Policy
You agree to use the Platform only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Platform. Prohibited behavior includes:
- Harassment, bullying, or abusive language toward other users
- Discrimination based on protected characteristics
- Spamming, phishing, or attempting to obtain user credentials
- Spreading malware or engaging in hacking activities
- Creating content that violates intellectual property rights
- Fraud, misrepresentation, or deceptive practices
- Circumventing security measures or platform restrictions
6. Prohibited Conduct
Users may not:
- Post, upload, or distribute content that is illegal, obscene, or defamatory
- Engage in activities that interfere with Platform functionality
- Attempt to gain unauthorized access to Platform systems
- Reverse engineer, decompile, or attempt to discover Platform source code
- Use automated tools to scrape or collect data without permission
- Engage in price manipulation or fraudulent transactions
- Violate any applicable local, state, or international law
Violation of these prohibitions may result in immediate account termination and legal action.
7. Platform Rights and Intellectual Property
The Platform and all content provided by DevLoot (excluding user-uploaded content) are the exclusive property of DevLoot and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access the Platform for lawful purposes only.
You may not:
- Reproduce or distribute DevLoot content without permission
- Remove or modify any copyright, trademark, or proprietary notices
- Use DevLoot trademarks or branding without written consent
- Create derivative works based on Platform infrastructure
DevLoot respects intellectual property rights and expects all users to do the same. See ourDMCA Policy for information on reporting copyright infringement.
8. User Content
For content you upload to the Platform:
Grant of Rights: You grant DevLoot a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of operating and improving the Platform.
Warranty: You warrant that you own or have rights to all content you upload, and that your content does not infringe on any third-party intellectual property rights or violate any laws.
Responsibility: You are solely responsible for your content. DevLoot does not endorse or assume responsibility for user-generated content and reserves the right to remove content that violates these terms.
By uploading content as a Creator, you represent that you are the original copyright holder or have obtained necessary permissions from all relevant rights holders.
9. Content Moderation and Removal
DevLoot reserves the right, in its sole discretion, to review, moderate, and remove any content that:
- Violates these Terms of Service
- Violates applicable laws or regulations
- Infringes intellectual property rights
- Contains malware or malicious code
- Is sexually explicit or exploitative
- Promotes violence, discrimination, or hatred
We may also suspend or terminate user accounts that repeatedly violate content policies. Creators who have content removed may request an explanation through our support system.
No content is guaranteed to remain on the Platform indefinitely. DevLoot may remove content for any reason, though we will generally provide notice when possible.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVLOOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data or information
- Interruption of service
- Defective products or services
- Damage to reputation or business
This limitation applies even if DevLoot has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of liability, so these limitations may not apply to you.
DevLoot's total liability to you for all claims arising from these Terms shall not exceed the amount you paid to DevLoot in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless DevLoot and its officers, directors, employees, agents, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Platform in an unlawful manner
- Your content infringing on third-party rights
- Your violation of applicable laws
- Your disputes with other users
This indemnification obligation shall survive termination of your account.
12. Dispute Resolution
Informal Resolution: Before initiating formal proceedings, we encourage you to contact us to attempt to resolve any disputes informally. Contact our support team at support@devloot.com with details of your dispute.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Arbitration: You and DevLoot agree that any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court. Each party shall bear its own legal fees and costs.
Small Claims Court: Notwithstanding the arbitration provision, either party may bring claims in small claims court if the dispute qualifies for small claims jurisdiction.
13. Modifications to Terms
DevLoot may modify these Terms of Service at any time. We will provide at least thirty (30) days' notice of material changes by posting the updated terms on the Platform and updating the "Last Updated" date.
Your continued use of the Platform after notice of modification constitutes your acceptance of the modified terms. If you do not agree to the modifications, you should discontinue use of the Platform.
14. Termination
Termination by You: You may terminate your account at any time by contacting our support team. Upon termination, you will no longer have access to your account, though DevLoot may retain certain information as required by law.
Termination by DevLoot: DevLoot may terminate or suspend your account immediately, without notice, if we determine that you have:
- Violated these Terms of Service
- Engaged in illegal activity
- Violated intellectual property rights
- Posed a security risk to the Platform
- Repeated abusive behavior toward other users
Upon termination, your right to use the Platform ceases immediately. DevLoot may delete your account and all associated content. Termination does not relieve you of obligations incurred before termination, including indemnification and intellectual property obligations.
15. Pre-Release Listings & Buyer Expectations
Some listings on the Platform are marked Beta or Alpha by the creator. These are deliberate pre-release labels for builds that are not production-ready. Badges are visible on the product card, detail page, and quick-view modal before you complete a purchase.
- Beta — feature-complete builds that may have rough edges, minor bugs, or incomplete documentation. Suitable for early-access use with realistic expectations.
- Alpha — early builds intended for testers willing to tolerate frequent breakage. Core features may be missing or change. Not suitable for production use.
- Stable (no badge) — production-ready listings.
Your Acknowledgement: By purchasing a listing marked Alpha or Beta, you acknowledge that the asset may not function as a finished product would, that the creator may issue breaking changes, and that update frequency may be higher than on a Stable listing.
Refund Eligibility: Our standard refund policy applies to pre-release listings. The stage label does not waive your right to a refund if the listing materially fails to match its description, nor does it automatically entitle you to one beyond the standard 14-day window.
Free Upgrades to Stable: Buyers of an Alpha or Beta listing receive future Stable versions of the same product at no additional cost, provided the product identity is retained across versions.
16. AI-Assisted Content Disclosure
Listings where the creator has self-disclosed generative-AI involvement display an “AI-assisted” badge on the product detail page and quick-view modal.
What It Means: The creator has disclosed that generative AI tools were used in a substantial part of the asset. This does not by itself mean the listing is AI-generated wholesale; it's a transparency signal so you can weigh it against your preferences before buying.
What It Does Not Mean: The presence or absence of the AI-assisted badge does not constitute a warranty by DevLoot that the listing is entirely human-made or entirely AI-made. Creators are solely responsible for the accuracy of their self-disclosure per the Creator Agreement.
Reporting: If you believe a listing has been mislabeled — either failing to disclose AI use where it was substantial, or incorrectly claiming AI involvement — report it via /contact. We review reports case-by-case and may require the creator to update disclosure or remove the listing.
17. DevLoot Pro (Creators)
DevLoot Pro is an optional paid subscription available to Creators. It reduces the DevLoot platform fee on direct sales, unlocks Creator Memberships (recurring subscriptions from followers), and enables additional tooling. Full Pro terms are in the Creator Agreement section 16.
Buyer Impact: Whether a creator is on the Free tier or Pro does not affect your rights or pricing as a buyer. Product prices, refund windows, and license terms are identical regardless of the creator's subscription status.
Pro Subscription Billing: Pro is billed by DevLoot (not via Stripe Connect) to the creator's payment method. Billing disputes related to a Pro subscription are between DevLoot and the subscribing creator, and are separate from any purchases buyers make from that creator's storefront.
